Privacy Policy

This policy explains how Nebiatek Inc. collects, uses, discloses, retains and protects personal information submitted through the website, contact requests and appointment requests.

1. Scope of this policy

This policy applies to personal information collected by Nebiatek Inc. through its public website, contact form, appointment requests, follow-up emails and interactions related to a request for information or services.

It does not replace any contract, statement of work, confidentiality agreement, data processing agreement or service-specific terms that may apply to a client engagement.

This policy is provided for transparency. It is not legal advice and may be supplemented by contractual terms that apply to specific services.

Nebiatek Inc. is a corporation incorporated on July 31, 2023, registered in Quebec under NEQ 1178960838, with an address at 910 rue Marmier, Longueuil, QC, J4K 4S2, Canada.

For privacy questions, access requests, correction requests, consent withdrawal or complaints, you may contact the person responsible for personal information protection at privacy@nebiatek.com.

3. Information we collect

We limit collection to information necessary for the purposes identified at the time of collection. Depending on your interaction with the site, information may include:

  • information submitted through the contact form: name, email address, organization name, message and communication language;
  • information needed to schedule an appointment or respond to a request;
  • information contained in emails, calls or follow-up communications;
  • minimal technical information related to browsing, security and website operation, such as IP address, browser type, device, technical logs or errors;
  • information you voluntarily choose to provide.

The public website does not ask for highly sensitive information. Please do not submit client files, passwords, banking information, tax documents or other confidential records through the public form.

4. How we use information

We use personal information for serious, legitimate and identified purposes, including to:

  • respond to your requests and communicate with you;
  • qualify your needs, prepare a meeting and schedule an appointment;
  • provide information about our services when relevant to your request;
  • operate, maintain, protect and improve website security;
  • comply with legal, regulatory, professional or contractual obligations;
  • prevent fraud, abuse, security incidents or unauthorized use.

Where the GDPR applies, legal bases may include your consent, pre-contractual steps taken at your request, Nebiatek's legitimate interests and compliance with legal obligations.

5. Consent and choices

When you submit a form, request an appointment or communicate with us, you consent to the use of the information necessary to process your request and provide relevant follow-up.

You may withdraw consent for certain uses or disclosures, subject to applicable legal, contractual or retention obligations. Withdrawal may limit our ability to respond to a request or provide certain follow-up.

6. Disclosure to service providers and third parties

We do not sell personal information. We may disclose it only when necessary for the purposes described above, such as to providers of forms, automation, appointment scheduling, hosting, email, security, typography or technical support services.

Some providers may process or store information outside Quebec or Canada. When this occurs, we use reasonable contractual, administrative and technical safeguards to protect the information and limit access to what is necessary.

External links may lead to partner websites or third-party platforms. Those websites are governed by their own policies and practices.

7. Retention and destruction

Contact requests and prospect information are generally retained for up to 24 months, unless an active business relationship, legal obligation, contractual obligation, dispute or applicable request requires a different retention period.

When the purposes of collection have been fulfilled, information is securely destroyed, anonymized or de-identified where appropriate and permitted.

8. Cookies, technologies and browsing

The public website currently does not include advertising cookies, marketing pixels or behavioural analytics tools actively integrated into the site's code. Technical information may still be processed to load pages, display typography, secure communications, diagnose errors and maintain the site.

If Nebiatek adds identification, localization, profiling, analytics or marketing technologies that require additional notice or consent, this policy and the related choice mechanisms will be updated accordingly.

9. Safeguards and incidents

Nebiatek applies reasonable measures proportionate to the sensitivity, purpose, quantity and format of the information to protect it against loss, theft, unauthorized access, unauthorized disclosure and improper use.

If a confidentiality incident involving personal information occurs, Nebiatek will take reasonable steps to reduce risk, document the incident and notify affected individuals or competent authorities where required by law.

10. Your rights

Depending on the applicable laws, you may request access to your personal information, correction, withdrawal of consent, deletion where applicable, cessation of dissemination or a copy in a structured technological format where the right to portability applies.

If the GDPR applies to your situation, you may also have the right to restriction of processing, objection, portability, erasure and the right to lodge a complaint with a competent data protection authority.

11. Changes to this policy

Nebiatek may update this policy to reflect legal, operational or technological changes. The update date at the top of this page identifies the most recent version.
